It makes sense to clear passengers on flights entering US Airspace and seems (probably) within their rights to do so.&lt;/p&gt;&lt;p&gt;For instance, it would be easy for a terrorist to bypass US security measures simply by boarding a plane crossing US Territory and hijacking it.&lt;/p&gt;&lt;p&gt;That being said, the risk of this is so minor and I believe the DHS' true benefits so minute that this should no be happening.
