The mark-to-market issue has been a tricky one. Initially firms were able to come up with their own arbitrary formulas for valuation which allowed them to fudge numbers however they wanted. This post is mostly talking about the politics behind the failure, since regardless of whether the bill should or should not pass the House and Senate leadership is saying it should.&lt;br&gt;&lt;br&gt;I agree that the powers granted to the Secretary of the Treasury are the biggest concern in the legislation.
